Please read these Terms of Service ("Terms", "Agreement") carefully before using the services offered by FastTrackHazmat ("we", "us", "our"). By accessing or using our services, you agree to be bound by these Terms.
Important Notice: These Terms contain an arbitration clause and class action waiver that affect your legal rights. Please review Section 17 carefully.
1. Acceptance of Terms
By accessing fasttrackhazmat.com, purchasing our services, or communicating with our team, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use our services.
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any modifications indicates your acceptance of the updated Terms.
2. Service Description
FastTrackHazmat provides hazmat compliance services for e-commerce sellers, including product assessments, Safety Data Sheet (SDS) creation, and marketplace reinstatement support. Our services are delivered in a two-step process:
2.1 Product Assessment Service ($99)
The Product Assessment is a professional evaluation service that includes:
Review of your product's ingredients, formulation, and marketplace status
Analysis of hazmat classification and compliance requirements
Feasibility assessment for marketplace reinstatement
Detailed written report with clear recommendations
Determination of required documentation pathway (SDS, exemption sheet, or both)
Important: The $99 Product Assessment fee is non-refundable. This fee covers our expert review time, chemical analysis, and the preparation of your detailed assessment report, regardless of the outcome.
Assessment Outcomes:
Green Light 🟢: Your product can be reinstated. We will outline the exact documentation requirements and offer our full SDS creation service (additional fee applies) with our 100% Money-Back Guarantee.
Red Light 🔴: Your product contains restricted substances or falls under marketplace bans that cannot be overcome with documentation alone. We will explain why and suggest alternatives where possible.
2.2 SDS Creation Service (Optional - Additional Fee)
If your product receives a Green Light assessment, you may optionally purchase our full SDS creation service, which includes:

3. 100% Money-Back Guarantee (SDS Service Only)
Our Guarantee: If we cannot get your product reinstated on the target marketplace after creating your compliant SDS and providing reinstatement support, you will receive a full refund of the SDS creation service fee.
3.1 Guarantee Coverage
The 100% Money-Back Guarantee applies only to the SDS creation service (not the $99 assessment). To be eligible for a refund, the following conditions must be met:

3.2 Guarantee Exclusions

3.3 Refund Process

4. Client Responsibilities
To receive optimal service, you agree to:

4.2 Communication

Notify us of any marketplace communications or status changes
Follow our reinstatement instructions carefully
4.3 Marketplace Submission
Submit documentation to the correct marketplace team as instructed
Use the communication scripts we provide
Forward marketplace responses to us for review
Do not modify or alter the documentation we provide
Critical: Providing inaccurate information or failing to follow our guidance may result in rejection and will void the Money-Back Guarantee.
5. Service Limitations and Disclaimers
5.1 No Guarantee of Marketplace Acceptance
While we create compliant documentation and provide expert guidance, we do not control marketplace compliance decisions. Final approval or rejection is at the sole discretion of Amazon, TikTok Shop, Walmart, or other marketplace platforms. We cannot guarantee:
Marketplace approval timelines
Specific marketplace policy interpretations
Changes to marketplace requirements after submission
Reversal of account-level restrictions or suspensions
5.2 Assessment Accuracy
Our Product Assessment is based on the information you provide and our professional expertise. While we conduct thorough reviews, we cannot guarantee:
That marketplace policies won't change after the assessment
Outcomes for products with incomplete or withheld ingredient information
That marketplaces will interpret regulations the same way we do
5.3 Regulatory Compliance
Our services focus on marketplace compliance and hazmat classification. We are not a regulatory authority and do not provide:
Legal advice or legal representation
Certification that your product complies with all applicable laws
Approval to sell your product in specific regions
Guarantees regarding product safety or liability
Product registration or regulatory submissions
You remain responsible for ensuring your products comply with all applicable laws, regulations, and safety requirements in your target markets.
5.4 Third-Party Actions
We are not responsible for:
Actions taken by marketplace platforms (Amazon, TikTok Shop, Walmart, etc.)
Changes to marketplace policies or requirements
Delays in marketplace review processes
Errors or omissions by third-party suppliers or manufacturers
Product formulation changes made by your suppliers
6. Delivery and Timelines
6.1 Product Assessment
Standard Delivery: 24-48 hours after receiving complete product information
Complex products may require additional time (we will notify you if this is the case)
6.2 SDS Creation Service
Standard Delivery: 3-5 business days after order confirmation
Rush service available for an additional fee (24-48 hour delivery)
Timelines assume you provide complete and accurate information upfront
6.3 Marketplace Review
Marketplace review times vary: typically 7-14 days, but can be longer
We provide ongoing support during the marketplace review process
We cannot expedite marketplace review timelines
7. Payment Terms
7.1 Payment Processing
We accept payment via Stripe and PayPal
All fees are in GBP (£) or USD ($) as displayed at checkout
Payment is due in full before services commence
You authorize us to charge your payment method for the services purchased
7.2 Assessment Fee
The $99 Product Assessment fee is charged upfront
This fee is non-refundable under any circumstances
The assessment fee is separate from and does not include the SDS creation service
7.3 SDS Creation Service Fee

7.4 Currency and Taxes
All prices displayed exclude VAT unless otherwise stated
VAT will be charged at the applicable rate based on your location
You are responsible for any additional taxes or duties in your jurisdiction
8. Confidentiality

Use your information solely for providing our services

Sign Non-Disclosure Agreements (NDAs) upon request

Required by law or legal process

You provide explicit written consent
8.3 Data Retention
We retain copies of created documentation for 7 years for quality assurance and compliance purposes
Documentation is stored securely and access is restricted to authorized personnel only
9. Intellectual Property
9.1 Ownership of Created Documents
Upon full payment, you own the Safety Data Sheets and compliance documents we create for your specific products
You may use these documents for their intended purpose (marketplace submissions, compliance)
You may not resell, redistribute, or license our documents to third parties
9.2 Our Intellectual Property
All methodologies, templates, processes, and systems remain our property
Our website content, branding, and marketing materials are protected by copyright
You may not reproduce, modify, or create derivative works from our materials without written permission
9.3 Your Product Information
You retain all rights to your product formulations and proprietary information
You grant us a limited license to use this information solely for providing our services
10. Limitation of Liability
Important Legal Protection: Please read this section carefully as it limits our liability to you.
10.1 Maximum Liability
To the maximum extent permitted by law, our total liability to you for any claims arising from our services is limited to the amount you paid us for the specific service giving rise to the claim.
For example:
If you purchased only the $99 assessment, our maximum liability is $99
If you purchased the SDS service for $749, our maximum liability is $749
10.2 Excluded Damages
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
Lost profits or revenue
Loss of inventory or business opportunities
Marketplace account suspensions or restrictions
Damage to business reputation
Cost of substitute services
Loss of data or business information
This limitation applies even if we have been advised of the possibility of such damages.
10.3 Basis of the Bargain
You acknowledge that we have set our prices and entered into this Agreement in reliance upon the liability limitations set forth herein, which allocate risk between us and form the basis of our bargain.
11. Indemnification
You agree to indemnify, defend, and hold harmless FastTrackHazmat, its employees, contractors, and partners from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from:
Your violation of these Terms
Your violation of any laws or regulations
Your product's non-compliance with applicable safety or regulatory requirements
Inaccurate or misleading information you provided
Your failure to follow our guidance or instructions
Product liability claims related to your products
Third-party claims arising from your use of our services
12. No Warranties
Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to:
Implied warranties of merchantability
Fitness for a particular purpose
Non-infringement
Uninterrupted or error-free service
Accuracy or reliability of results
The only warranty we provide is the 100% Money-Back Guarantee for the SDS creation service, as detailed in Section 3.
13. Termination
13.1 By You
You may terminate your use of our services at any time. However:
The $99 assessment fee is non-refundable
If you terminate after purchasing the SDS service but before delivery, you may receive a partial refund at our discretion
Once documentation is delivered, no refunds are available except under the Money-Back Guarantee terms
13.2 By Us
We may terminate or suspend services if you:
Violate these Terms
Provide false or misleading information
Engage in abusive or threatening behavior toward our team
Fail to pay for services
Request services for illegal or prohibited products
13.3 Effect of Termination

You retain ownership of any delivered documentation

14. Prohibited Products

Prohibited by marketplace policies (e.g., weapons, explosives, illegal drugs)
Designed to circumvent marketplace safety restrictions
Deliberately mislabeled or misrepresented
Subject to specific bans we identify during assessment
If we discover your product falls into a prohibited category, we reserve the right to refuse service. In such cases, the assessment fee remains non-refundable as it covers our review time.
15. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
Natural disasters, pandemics, or public health emergencies
Government actions, laws, or regulations
Wars, terrorism, or civil unrest
Internet or telecommunications failures
Third-party service provider outages
Marketplace platform changes or shutdowns
16. Governing Law and Jurisdiction
These Terms are governed by the laws of Northern Ireland and the United Kingdom, without regard to conflict of law principles.
For disputes not subject to arbitration (see Section 17), you agree that any legal action must be brought in the courts of Northern Ireland, and you consent to the exclusive jurisdiction of such courts.
17. Dispute Resolution and Arbitration
17.1 Informal Resolution
Before initiating any formal dispute resolution process, you agree to contact us at [email protected] to attempt to resolve the issue informally. We commit to working with you in good faith for at least 30 days to resolve any disputes.
17.2 Arbitration Agreement
If informal resolution fails, any dispute arising from these Terms or our services shall be resolved through binding arbitration, except where prohibited by law. The arbitration will be conducted under the rules of a recognized arbitration body in Northern Ireland.
17.3 Class Action Waiver
You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative action. You waive the right to participate in any class action against us.
17.4 Exceptions
Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.
18. Miscellaneous Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FastTrackHazmat regarding our services and supersede all prior agreements or understandings.
18.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
18.3 Waiver
Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
18.4 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
18.5 No Agency
These Terms do not create any agency, partnership, joint venture, or employment relationship between you and FastTrackHazmat.
18.6 Survival
Provisions that by their nature should survive termination (including confidentiality, indemnification, limitation of liability, and dispute resolution) will survive the termination of these Terms.
18.7 Notices
All notices under these Terms must be in writing and sent to:
